We the Subscribers do appraise the Crop of grain growing in the ground the property of James Creps deceased of Mount Joy Township Adams Co. Pa - for the Sum of $25.00 this 9th day of June 1851.

Be it remembered that on the 14th day of June 1851 - Personaly appraised before the Subscriber one of the Justices of the peace in and for said County James Rider and Henry Benner the appraisers of the above goods and chattels who being duely Sworn according to law doth deposeand say that the above inventory is a just and true valuation or apraisemnt of the above property of the said James Creps deceased to the best of their Judgement and Knowledge and further saith not.

The objector holding a claim against this Estate which remains unpaid, and the account purporting to be a Final Account and showing a balance in favor of Accountant he accepts to all the items on the credit side of account, except those for the necessary expenses of administration and those purposed by act of assembly ( if any )

Exceptions to Report of Auditor on acct. of Josiah Baumgartner Administrator of James Creps deceased. Filed Nov. 29th 1852

Exceptions to the Report of Auditor to settle disputed items in the account of Josiah Baumgartner Administrator of James Creps deceased.

1. The Auditor errored in allowing credit to accountant in adjusting claim of John Creps for the item of $55.40 ; First Report.

2. The Auditor errored in allowing credit to accountant in adjusting claim of John Creps for the item of $61.60 ; First Report.

3. The Auditor errored in not ( under the law and the evidence ) reporting the sum of $58.88, as balance due John Creps and declaring a dividend in his favor on said sum.

The Petition of John L. Crabbs one of the minor children of James Crabbs late of Mountjoy Township deceased.
Humbly showeth,
That he is a minor over 14 years of age, and entittled to a share out of the Estate of his said father; and the he has no person legally appointed his Guardian to take care of his person and Estate. He there fore prays your Honors to permit him to make choice of a suitable person for his Guardian for the purpose aforesaid; and respectfully suggest Peter Greenholtz as such proper person, whom he is desirous of choosing, and he will pray. The Petition of Wilson Francis, Albert Dallas and Emma Eliza Crabbs three of the minor children of James Crabbs late of Mountjoy Township in said County deceased.
Humbly showeth,
That they are minors under 14 years of age and are entittled to distribution portions of the Estate of their said deceased father James Crabbs; and have no person legally appointed their Guardian to take care of their persons and estate. They therefore pray your Honors to appoint some suitable person as their Guardian for the purpose aforesaid and Alexander Crabbs is suggested as a suitable person and they will pray. The Court on motion appoint Alexander Crabbs Guardian of Mary Crabbs, ad litem, and the Court grants a Rule upon Josiah Baumgartner Administrator of James Crabbs dec. Susan Crabbs his widow, and upon the children & guardians of the minor children of James Crabbs dec., to show cause why the prayer of the petition should not be granted and decree made accordingly, returnable on the 3rd Monday of August 1858, Service to be made on those Heirs residing in Adams County, personally and service upon those residing out of the County, by publication for 3 successive weeks in one newspaper published in the Borough of Gettysburg and sending copies by mail addressed to them, at their respective post offices.

At an Orphans Court held at Gettysbury in and for said County on the 26th day of May A.D. 1858, before the Honorable Robert J. Fisher President and Isaac E. Wiesman, Esquire, Associates Judges duly assigned.

The Petition of Peter D. Crabbs, George L. Crabbs, Deliah Crabbs, Mary Crabbs and David Crabbs Guardian of William F., John Dixon and Ellen Eliza Crabbs, ( minor ) being all of the Children, and Civilla Crabbs, the widow of George Crabbs late of Germany Township in said County dec. Respectfully Showeth, That James Crabbs late of Germany Township in said County of Adams, dec. in his life time, to wit, on the 17th day of January A.D. 1852, obtained a Deed of conveyand in fee of a certain parcel of land, situate in Germany Township, in said County, containing one Acre, one road, and nineteen perches, adjoining lands of Jonathan C. Forrest, Danial Geiselman and John Davidson.
That the said James Crabbs, on the 16th day of November A.D. 1841, in and by certain Articles of Agreement entered in to by said George Crabbs, the said James Crabbs, did covenant and agree to build a house on said above described Lot of Ground, to be erected of the dimensions specified, and to be fit to move in, by the 1st of April 1852 and also to pay said George Crabbs, the sum of twenty-five dollars; the said conveyance being in consideration of the tranfer and conveyance by said George Crabbs of all the right title claim and interest and demand of the said George Crabbs in the Estate of his father Peter Crabbs dec. both Real and personal, unto the said James Crabbs, ( who was also the Executor of the Will of Peter Crabbs dec. ) and in said agreement, said James Crabbs further agreed that when

the house was built and the $25.00 paid or secured to be paid, he the said James shall and will give unto his said brother George or to some one else in trust for him, a Deed of Conveyance for the said house and lot and his heirs and assigns forever, clear of incumbance, and the said parties in and by said Articles of Agreement bound themselves under their hands and seals in the penalty of $700.00 as by reference to said Articles a true copy of which is attached, appears.
That pursuant to said agreement the said James Crabbs having procured a conveyance of said Lot as aforesaid, and erected said building or dwelling house, delivered possession there of unto said George Crabbs and the said premises remained in his possession, until the death of said George Crabbs, which happened on the 31st day of March A.D. 1853, and since his death have remained in the possession of your Petitioners, That the consideration in the said Articles stipulated was fully turned over to and received by the said James Crabbs in his life time - but that the said James Crabbs never did make and deliver to said George Crabbs, or any one in trust for him or his Heirs a conveyance as by him Stipulated to be given. That the said James Crabbs died on the <large space here> day of July A.D. 1852, intestate and letters of Administration were granted on his Estate, to Josiah Baumgartner, by the Register of Adams County that said James Crabbs left surviving him a Widow Susan Crabbs and issue as follows, to wit, Joseph A. Crabbs, and Alexander Crabbs adults, and John L. Crabbs a minor having Peter Greenholtz for his Guardian and Wilson F., Albert Dallas and Emma E. Crabbs, also minors and having Alexander Crabbs for their Guardian, and Mary Crabbs also a minor, that no Sufficient provision for the performance of the said contract or agreement

appears to have been made by the said James Crabbs dec. in his life time, although he was well satisfied and intended that the conveyance should be made.
Your petitioners therefore humbly pray this Honorable Court to receive proof of the Contract of Articles of Agreement, in order to the completing of their title and to decree the specific performance there of according to the true intent and meaning there of, according to the Act of Assembly in such case made and provided, and that your Honorable Court will make such other orders and decrees in the premises, as to them may seem, meet and proper so as to vest the legal title in, and effect conveyance of said House and Lot and premisis to your petitioners, And they will pray thee.

And now, to wit, May 26th A.D. 1858 The Court on motion appoint Alexander Crabbs Guardian of Mary Crabbs, ad litem, and the Court grants a Rule upon Josiah Baumgartner Administrator of James Crabbs dec. Susan Crabbs his widow, and upon the children & guardians of the minor children of James Crabbs dec., to show cause why the prayer of the petition should not be granted and decree made accordingly, returnable on the 3rd Monday of August 1858, Service to be made on those Heirs residing in Adams County, personally and service upon those residing out of the County, by publication for 3 successive weeks in one newspaper published in the Borough of Gettysburg and sending copies by mail addressed to them, at their respective post offices.

In the Orphans Court of Adams County. I the matter of the petition of the Widow and Heirs of George Crabbs late of German Township Deceased praying the Court to receive proof of and for a decree for the specific performance of a contract on articles of agreements entered into by James Crabbs deceased with the decedent and the Rule granted upon the 26th of May 1858, upon the Administrator Widow and Heirs of James Crabbs deceased, to show cause why the prayer of the petition should not be granted and decree made accordingly. We the Widow Administrator and children and Guardians of children of James Crabbs deceased, do hereby accept notice and waive and dispense with publication and services of the said Rule to show cause granted upon us, with like effect as if service had been regularly made, We admit the execution of the said Articles of agreement and hereby consent and agree that a Decree be made agreeably to the prayer of the petition and Witness our hands, July 19th 1858. And now August 16th 1858, all the parties in interest having filed their consent that a decree be made according to the prayer of the petition, and the Court upon due proof and consideration, had of the premises, being of the opinion that the facts set forth in this case are sufficient in equity to require them to decree the completion and specific performance of the written Contract, and decree the Josiah Baumgardner Administrator of James Crabbs dec. do make, execute and deliver to Jonathan C. Forest Esq. in trust for Peter D. Crabbs, George L. Crabbs, Deliah Crabbs, Mary Crabbs, William F. Crabbs, John Dixon Crabbs, and Ellen Eliza Crabbs, the children and heirs at law of George Crabbs dec. a Deed of Conveyance in fee simple, for the premises in the said Petition mentioned, pursuant to the said Contract, the expenses of this proceeding and of such conveyance to be paid by the Petitioners.
